2) In view of this, the learned counsel for the applicant seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. The learned Sessions Judge shall proceed with the recording of the evidence, irrespective of the fact that any of the accused has filed an application seeking discharge.
