P.C.:- This is an Application for restoration of Revision Application No.376 of 2007, which was dismissed for non-prosecution by Order dated 17th March, 2022 passed by this Court.

The present Application is filed within a period of limitation. Mr. Nighot, learned Advocate for the Respondent pointed out that, even on earlier occasion i.e. on 12th December, 2011, the said Revision Application was dismissed for non-prosecution and by Order dated 21st September, 2017 passed in Civil Application No.631 of 2015, the same was restored to file by imposing a costs of Rs.1 lakh upon the Applicant. 1/2

ssm 2 22-civil-ia2311.22.doc In view thereof, the learned Advocate for the Applicant submitted and offered that, the Applicant will pay a cost of Rs.25,000/- for restoration of the present Revision Application. The said statement is accepted.

The said cost of Rs.25,000/- be paid to the Kirtikar Law Library, High Court, Mumbai within a period of two weeks from today. Subject to payment of aforestated cost, Application is allowed in terms of prayer clause (b).
