Heard the learned counsel for the parties.

This application is preferred by State of Maharashtra for condonation of 400 days delay in filing First Appeal challenging the decree dated 18.12.2013 passed by Joint Civil Judge, Senior Division, Ratnagiri in Special C.S.No.110 of 2010 (Old Suit No.238 of 2008).

Considering the submissions made by the learned A.G.P. for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order: a) Civil Application is allowed in terms of prayer Mohite 1/2

"b) This Hon'ble Court be pleased to condone the delay of 1 year and 35 days in preferring abovementioned First Appeal against the Judgment and Order dated 18.12.2013 passed by Learned Joint Civil Judge, Senior Division, Ratnagiri in Special Civil Suit (No.110 of 2010)."

b) Civil application stands disposed off accordingly.

c) Applicant to pay cost as per the Appellate Side rules.
