This Application is moved for bail. The applicant/accused is involved in the crime and facing charges under sections 408, 409 r/w. 34 of the Indian Penal Code and Section 6(iv) of Sarvajanik Vitaran Vyvasata Rules, 2001 and also under sections 3 and 7 of the Essential Commodities Act. As per the case of the prosecution, nearly 30,000 quintals of foodgrains such as rice, wheat and sugar were misappropriated by the accused persons and thereby caused loss to the extent of Rs.5,06,58,640/- to the Government. The offence took place during the period of 30th September, 2014 to 19th December, 2014. When this was noticed by the Government officers, one Dyaneshwar Bhivsen Javjaal, District Supply officer gave information to the police, pursuant to which an offence was registered on 26th January, 2015 at C.R. No. I-9/2015 with Surgana Police Station, District Nashik. The applicant/accused was arrested on 17th February, 1 / 3

2015. Hence this Bail Application.

The learned senior counsel for the applicant/accused has submitted that the applicant/accused was working as a Manager of the godown which is owned by co-accused Vijay Wagh. He submitted that Vijay Wagh is granted pre-arrest bail by this Court by its order dated 23rd March, 2015 in Anticipatory Bail Application No. 330 of 2015. The learned senior counsel submitted that the applicant is a private person. He further submitted that the applicant/accused has lost his father Ramdas Namdeo Jadhav on 23rd April, 2015 at Nashik and therefore, the applicant/accused be released on bail to attend his further rituals. 3.

Learned APP opposed the Application, however, on instructions from the Investigation Officer, she submitted that the investigation will be completed on 13th May, 2015 and the investigation against the applicant/accused is more or less complete.

In view of the submissions of learned senior counsel and learned APP, so also taking into fact that the applicant/accused has lost his father on 23rd April, 2015, the applicant/accused is granted bail on the following terms and conditions:

O R D E R

(i) The Application is allowed.

(ii) The applicant be enlarged on bail on furnishing P.R. Bond in a sum of Rs.20,000/- with one or two sureties in the like amount.

(iii) The applicant shall not tamper with the evidence. (iv) The applicant shall make himself available and attend all the Court dates.

(v) The applicant/accused shall not abscond and shall furnish his address to the police along with address proof. (vi) Violation of any of the conditions imposed shall amount to cancellation of bail forthwith.

(vii) The applicant shall not leave India without the prior permission of the Court.
