Heard. This Application is for fixing early date of hearing of the present appeal.

The learned counsel for the Applicant submits that this court (Coram : Anoop V. Mohta, J.) by order dated 03/09/2007 in Civil Application No.4468/2007 directed the office to place the matter on board for final hearing after 6 weeks. He submits that thereafter the Applicant preferred one more Civil Application No.3452/2010 for the early hearing of the First Appeal, which was allowed by this court on 27/09/2010.

On the basis of these facts, the learned counsel for the Applicant submits that this Hon'ble Court be pleased to direct the office to place the First Appeal for final hearing.

Considering the submissions made by the learned counsel for the Applicant and the orders dated 03/09/2007 and 27/09/2010, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Office is directed to place the First Appeal on weekly board for final hearing as per its turn as per order dated 27/09/2010.

b) Civil application stands disposed off accordingly.
