By this Application under Section 115 of the Code of Civil Procedure, 1908, applicant has challenged the judgment and order dated 02.02.2016 passed by the learned Joint Civil Judge, Junior Division, Jaysingpur in Regular Civil Suit No.174 of 2015. By that order, the learned trial Judge partly allowed the application made defendants under Section 8 of the Arbitration and Conciliation Act, 1996 (for short 'Act') for referring the parties to arbitration as per arbitration clause 29 of the loan agreement for settlement of dispute.

After arguing the Application for quite some time, Mr. Patil, upon taking instructions from Mr. Kiran Nagappa Mali, son of the applicant, seeks permission to withdraw the Application. He has tendered photocopy of Aadhar card of Mr. Kiran N. Mali, which is taken on record and marked 'X' for identification.
