ssm 2 901-caw898.16.sxw The statement is made by the learned counsel appearing for the Applicant-Petitioner that in pursuance of order dated 16 March 2016, Appeal was filed before the Appellate Authority. By order dated 29 April 2016, the said Appeal was dismissed solely on the ground of want of power to condone the delay. In view of this and even otherwise, no case is made out.

Civil Application No. 899 of 2016 is accordingly dismissed. No costs. It is open for the Applicant-Petitioner to take out appropriate proceedings against order dated 29 April 2016 passed by the Appellate Authority.

In the result, Civil Application No. 898 of 2016 for stay is also dismissed. No costs.
