IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO.5969 OF 2013 Virag Atmaram Patil ...
Petitioner V/s.
State of Maharashtra & Ors.
...
Respondents ......
Mr. S. G. Talekar, Advocate for the Petitioner. Mr. P. P. Kakade, AGP for Respondent Nos. 1 to 4. ......
CORAM : NARESH H. PATIL AND S.B. SHUKRE, JJ.
DATED :
SEPTEMBER 11, 2015.
P.C.
The first voters list was published on 4th April, 2012 and second voters list was published on 8th May, 2012. The petitioner submits that he contested Gram-Panchayat election in the year 2012. The petitioner was not made aware of the changes made in the voters list, as election was held on 24th May, 2013. Admittedly, the petitioner has not approached the Election Tribunal.
rpa 2/3 The grievance of the counsel is that certain officers are involved and due to their act supplementary voters list was prepared wherein names of dead persons were transferred from one ward to another ward.
We have perused the affidavit filed by the Deputy Collector (General), District Thane. The petitioner failed to resort to statutory remedy which was alternate and efficacious in nature. The elections are already over in the year 2012. No interference is warranted under extraordinary writ jurisdiction of this Court. Writ Petition is dismissed. (S. B. SHUKRE, J.) (NARESH H. PATIL, J.)
