This is an application for condonation of delay of 16 days in filing the appeal.

Learned Counsel for the applicant submits that he has filed the appeal against the judgment and award dated 27.11.2012 passed by the learned Member, Motor Accident Claims Tribunal, Mumbai, in M.A.C.P. No.1004 of 2006. The learned Counsel submits that due to lack of technical knowledge and due to accident, the applicant has sustained fractures and injuries. There were restrictions on his mobility and hence, the delay is caused.

The learned Counsel for Respondent No.2 insurance company is present and submits to the orders of the Court. 4.

In view of the uncontroverted submissions and the period of delay, the application is allowed. Appeal be numbered and listed for admission as per CMIS date.
