Limited relief sought in the application to the effect that the proceedings which the applicant has instituted under Section 498A before the 12th Court, Metropolitan Magistrate, Bandra, Mumbai be expedited. It is contended that the said proceedings are pending since 9 years, being instituted in the year 2007. 2.
On the last date this Court had asked the learned APP to produce the case wise pendency of the learned Metropolitan Magistrate Court at Bandra. Accordingly, the learned APP has produced on record the pendency chart, from which it is reflected N.S. Kamble page 1 of 2
910-appln-168-2017 that the 12th Court, Metropolitan Magistrate, the pendency as on 15.08.2018, is 11,162 cases.
In such circumstances taking into consideration the huge pendency before the said Court, it would not be appropriate to fix a time schedule and burden the said Court since, there might be some other cases which requires urgent disposal or hearing. In such circumstances this Court would only observe that Metropolitan Magistrate would make all endeavour to expeditiously dispose of the case No.1352/PW/08 arising out of FIR No.547 of 2007.
