On last date, this Court has given last chance to the Respondent to go on with the matter. Today also none present for the Respondent.

By this Application, Applicant is seeking transfer of the divorce petition pending at Family Court Pune filed by the Respondent to Family Court, Nashik. Where the proceeding filed by the Applicant for maintenance and under Domestic Violence Act are pending.

It is contention of learned counsel for the Applicant that Applicant stays with her father at Nashik and her father is suffering from spondylosis. She has no source of income. She cannot attend the dates at Family Court Pune, which is around 220 km distance from Nashik. Hence, requested to allow the Appeal. 5.
As none present for the Respondent hence, I am deciding this appeal on merit.

Applicant has filed petition against the Respondent for maintenance and under Domestic Violence Act, which are pending at Nashik.

The Respondent has filed petition for divorce against the Applicant, which is pending at Family Court, Pune. Applicant stays with her parents at Nashik, her father is suffering from spondylosis. It appears that inconvenience would be caused to the Applicant to attend the dates at Family Court, Pune.

In view of above, I pass following order.
ORDER
i. Application is allowed.
ii. Petition No. A-1499 of 2021 pending before the Family Court, Pune be transferred to Family Court, 2/3
Nashik.
iii. Application is disposed of.
