This is an Application under Section 439 of Cr. P.C. for bail in CR No. 382 of 2015 registered with Nirmal Nagar Police Station, Mumbai under Sections 307, 141, 143, 144, 147, 148,149, 323, 504 and 506 of the Indian Penal Code.

Heard the learned counsel for the Applicant, the learned APP for State.

Perused the entire charge-sheet.

The learned counsel for the Applicant submitted that coaccused namely Hasan s/o. Anwar Ali Shaikh who has been attributed with same and/or similar role has been released on bail by this Court by an Order dated 02.11.2017 and therefore, the Applicant is entitled to

I find substance in the submission made by the learned counsel for the Applicant. The Applicant is similarly situated as that of Hasan Shaikh who has been released on bail by this Court and therefore, the Applicant is entitled to be released on bail on the ground of parity. Hence, the following Order:
(i) The Applicant be released on bail in CR No. 382 of 2015 registered with Nirmal Nagar Police Station, Mumbai on his furnishing PR bond of Rs. 25,000/- with one or two solvent local sureties in the like amount.
(ii) After his release from the jail, the Applicant shall attend Nirmal Nagar Police Station, Mumbai on the first Saturday of every month between 11.00 a.m. to 1.00 p.m. till the conclusion of trial. (iii) Applicant shall also attend all the dates before the trial Court.
(iv) Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
