By an order dated 30/03/2017, the applicant was granted interim relief and was further directed to attend the Investigating Officer as and when called for between 11.00 a.m. to 02.00 p.m. and join the process of investigation. 2.
It is the case of prosecution that a raid was conducted on the Hotel Love Bird Bar & Restaurant, at Juhu Tara Road, Santacrus, Mumbai and that time, it was found that certain ladies were dancing at the said premises in obscene manner. It is Nesarikar

It is to be noted here that on the date of conduction of raid i.e. 28/12/2016 the applicant was not present in the said hotel. During the course of said raid, no minor girls were found and the ladies who were found at the spot have stated that they have entered into the said vocation on their own volition. In view of the peculiar facts of the present case the custodial interrogation of the applicant is not necessary and the applicant has made out his case for release on pre-arrest bail. 4.
In view of above, the interim relief granted by order dated 30/03/2017 is hereby confirmed.
