In view of the stand taken by the Respondent-State in reply stating therein that the steps are being taken for issuance of licence in favour of the Petitioner subject to verification of the distance from the National / State Highway, the learned counsel for the Petitioner submits that the Petition may be disposed of by directing the District Aswale 1/2

520.wp.3909.17.doc Collector to expedite the decision in regard to the issuance of the licence in favour of the Petitioner and the District Collector be also directed to consider the Petitioner's claim for adjustment of the licence fees which has been paid by the Petitioner for the year 2016-2017 for which the licence was not issued.

Keeping in view the aforesaid submission, we dispose of this Petition by directing the District Collector to take appropriate decision on the Petitioner's prayer for issuance of licence for the year 2017-2018 as expeditiously as possible in regard to the refund of the licence fees which has been paid by the Petitioner for the preceding year, the District Collector shall take appropriate decision in accordance with law either to refund it or to adjust it as may be permissible.

With the aforesaid directions, the Writ Petition is disposed of.
