This petition by the workman challenges the award dated 18th August, 2014 by which the Labour Court dismissed the Reference (IDA) No.242 of 2012 for reinstatement with continuity of services and back wages. The Labour Court has observed in the award that the petitioner has not proved his claim that he had worked for more than 240 days in the year with the respondent. Perusal of the affidavit of examination-in-chief of the petitioner confirms this finding. The petitioner has not uttered even a word as to his work with the respondent for more than 240 days in his deposition. There is no infirmity in the impugned order. Hence the petition is dismissed.
