The Petition is filed challenging the Public Auction dated 15.03.2017 conducted by Respondent Nos. 1 to 3. During the pendency of Petition, election to the managing committee of Respondent No. 1 was held and the newly elected Chairman of Respondent No. 1 cancelled the Public Auction impugned in this petition. The successful bidders, challenged this order by filing an appeal before the State Government which is pending. Shubham

In the light of above, Mr. Jahagirdar learned Senior Counsel having taken instructions from his clients, seeks leave to withdraw the petition with liberty to file a fresh petition, in the event, the appellate order is adverse to petitioner's interest. 3.

Leave with liberty as prayed for is granted. Petition is disposed of. All points and contentions of the respective parties are kept open.
