Mr.Marne, learned counsel for the Respondent Nos.1 to 3, on instructions of Mr.Kiranraj Yadav, Deputy Commissioner (Administration), who is present in Court, states that the Petitioner will be permitted to join duty, pursuant to the order dated 12th April, 2012, passed by the Deputy Commissioner (Administration), Navi Mumbai Municipal Corporation; that the Petitioner will be given seniority from 12th April, 2012; and that the notional pay fixation will also be calculated from 12th April, 2012. Statement accepted. Mr.Marne, however, states that the
2/2 914-wp.cp.301.2017.doc actual benefits of payment will start from the date when the Petitioner joins the service. Learned Counsel for the Petitioner accepts the same. 2.
The Petitioner is present in Court and states that she will join the duties, within one week from today. Statement accepted. 3.
In view of the statement made by the learned counsel for the Respondent Nos.1 to 3, learned counsel for the Petitioner, on instructions, seeks leave to withdraw this Petition.

The Petition is accordingly disposed of as withdrawn on the aforesaid terms.

It is made clear, that the aforesaid order shall not be treated as a precedent, as the same is passed in the peculiar facts and circumstances of this case.
