Counsel for the applicant on instructions submits that in the pending divorce proceedings between the complainant and the applicant an amount of Rs.50,000/- shall be deposited within four weeks from today.

Since the statement is made on instructions, same is accepted as an undertaking to this Court.

As far as the issue of return of Stridhan is concerned, appropriate Courts taking up divorce proceedings shall look into the same.

In the aforesaid background, custodial interrogation of the applicant is not warranted, particularly, when there is unexplained delay for lodging FIR and the proceedings are arising out of matrimonial discord. Already divorce, so also maintenance proceedings are pending between the parties.
