Writ petition filed by the Applicants was dismissed for nonprosecution as against the Respondent Nos. 3 to 6 for non-payment of Bhata charges. Now the Rule regarding payment of Bhata charges has been repealed. Hence a case is made out for restoration. Accordingly, application is allowed in terms of prayer clauses (a) to (c) subject to condition of the applicants furnishing copies for effecting the service of notice to the Respondent Nos. 3 to 6. If copies are not furnished within a period of three weeks from today, the petition shall stand dismissed without further reference to this Court. If copies are furnished within stipulated time, notice of writ petition be issued to the Respondent Nos. 3 to 6 returnable on 18th August, 2017 (SMT. VIBHA KANKANWADI, J.) (A. S. OKA, J.)
