By this application, the applicants seek their enlargement on bail in connection with C.R. No. 59 of 2016, registered with the Lonikand Police Station, for the alleged offences punishable under Sections 326, 324, 323, 143, 147, 148, 149, 504, 506 of the Indian Penal Code. 3.

Learned Counsel for the applicants states that the applicant no.1 is alleged to have assaulted the complainant - Shamrao Shivaji Satav with the wrong side of the axe and the applicant no.2 - Kantaram Kisan Satav is alleged to have assaulted Ganesh Satav with an iron rod. He states that some of the accused have been granted anticipatory bail by this Court and that the nature of injuries sustained by the complainant as well as Ganesh Satav are not grievous in nature.

Learned APP has tendered the injury certificate of the complainant - Shamrao Shivaji Satav and Ganesh Satav. There is no obvious evidence of any fracture. As far as Ganesh Satav is concerned, he has received simple injuries.

Perused the papers. Considering the role attributed to the applicants and the nature of injuries sustained by the complainant and Ganesh Satav and the fact that the applicants have been in custody since 22nd February, 2016, the applicants are enlarged on bail on the following terms and conditions :

ORDER

(i) The Applicants be enlarged on bail on furnishing P.R. Bond in the sum of Rs.25,000/- each with one or two sureties in the like amount;

(ii) The applicants shall attend the concerned Police Station on the every Saturday between 10:00 a.m. to 11:00 a.m., till the filing of the charge-sheet and thereafter on the first Saturday of every month, between between 10:00 a.m. to 11:00 a.m., for a period of 12 months, from the date of filing of the charge-sheet; (iii) The applicants shall not tamper or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

4/4 (iv) The applicants to cooperate with the conduct of the trial. 6.

The Application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the observations made herein are prima facie, and the trial Court shall decide the case on its own merits, in accordance with law, uninfluenced by the observations made in this order. 8.

In view of the disposal of the Bail Application No.689 of 2016, the Intervention Application being Criminal Application No.280 of 2016 does not survive and the same is also disposed of. 9.
