This is the 2nd application for pre-arrest bail filed by the aforesaid Applicant apprehending his arrest in C.R.No.714/2022 registered at Tardeo Police Station, Mumbai for offences punishable under sections 406, 420 r/w. 34 of the Indian Penal Code.

The previous application for pre-arrest bail being Anticipatory Bail Application No.3257/2022 along with connected matter was allowed by this Court. By order dated 23/11/2022, the Applicant was directed to report to the Investigating Officer on 26th, 27th and 28th November, 2022 between 11:00 a.m. to 01:00 p.m. It is stated that the Applicant did not appear before the Investigating Officer. Hence, notice of arrest came to be issued. Learned counsel for the Applicant 1/2

P.H. Jayani 14 ABA906.2023.doc states that the Applicant did not appear before the Investigating Officer due to mistake. Said explanation cannot be accepted. No satisfactory explanation is forthcoming for breach of the conditions in the order dated 23/11/2022, in view of which, I am not inclined to exercise discretion under section 438 of Cr.P.C. Hence, the Application is dismissed.
