Learned APP submits that by Judgment and Order dated 16/04/2015. Applicant herein is convicted for offence punishable under section 392 of Indian Penal Code and is sentenced to suffer rigorous imprisonment for 11 months and to pay fine of Rs. 200/- i.d. to suffer simple imprisonment for 4 days.
2) It appears from communication that applicant was arrested on 11/06/2014 and has been an under trial prisoner. Applicant appears to have undergone the substantive sentence as
2/2 20.707.15 ba an under trial prisoner. Learned APP submits that applicant is still in jail. He may take recourse to appropriate proceedings, if so advised or else, he would be enlarged on account of having suffered substantive sentence as an under trial prisoner.
3) Prayer in the application for enlarging him on bail under section 436 (A) has become infructuous. Learned counsel for the applicant appointed for the applicant has put in best of efforts to espouse the cause of the applicant. His professional fees are quantified to the tune of Rs. 1000/- to be paid to him within 3 months from today. Order to be communicated to the applicant in jail.
4) Application is disposed of as infructuous.
