3 WP.6368/2016 & connected matters (5) that substantive appeals are pending before the District Court Sangli, at Sangli against the order 29th October, 2015 passed by the Joint Charitable Commissioner, Kolhapur, which is impugned in this Petition.

Learned Counsel appearing for the Petitioners prays that he may be allowed to withdraw all the Petitions with liberty to approach the learned Appellate Court raising all contentions taken up in these Writ Petitions.

The request made by the Petitioners deserves to be accepted. Keeping all the contentions of the Petitioners open on merits, the present Petitions are allowed to be withdrawn with a liberty to raise all the contentions raised in these Petitions before the learned Appellate Court at Sangli before whom the appeals are pending. 4.

It is expressly made clear that I have not gone in to the merits of the matter and all contentions on merits are kept open. All the Petitions are allowed to be withdrawn and accordingly disposed of. (M.S. KARNIK, J.)
