Heard the learned counsel for the parties.

The main grievance of the Petitioner is that though their Application dated 12.03.2018 is pending before Respondent no.3 in the matter of Maharashtra Project Affected Persons Rehabilitation Act, 1999 for granting alternate land, same is not decided by them on its own merits.

Considering the submissions made by the learned counsel for the Petitioner, this Writ Petition can be disposed of with a direction to Mohite 1/2

42 wp5828-18.doc Respondent no.3 Additional Collector, Pune to decide the Petitioner's Application dated 12.03.2018 (Exhibit-'I' page 27 of the petition) as early as possible but in any case within six months from today. Hence, following order is passed:

a) Respondent No.3, Additional Collector, Pune to decide the Petitioner's Application dated 12.03.2018 (Exhibit 'I' Page No.27 of the Petition) as early as possible but in any case within six months from today.

b) Authority to decide the same on its own merits. c) Learned A.G.P. is directed to communicate this order to the concerned authority immediately.

d) Writ Petition is disposed of accordingly.
