Mr. Yende, the learned counsel for the Applicant seeks leave to withdraw the application with liberty to file discharge application before the trial Court in the event police file a charge-sheet in the subject crime. Leave with liberty as prayed for is granted. Application is allowed to be withdrawn and is dismissed as such.
