Heard learned counsel for the parties.

By this Application, the Applicant seeks relaxation of the condition No.(iii) passed by this Court (CORAM : ABHAY M. THIPSAY, J.) in B.A.No.1496 of 2013 on 10.11.2014. The condition of which partial modification is sought (in bold) reads thus :- "(iii) The applicant shall report to the trial Court on every Monday, till the disposal of the case against him.

Should the trial Court be closed on a given Monday, the applicant shall attend the Court on the next working day. It is clarified that this shall be in addition to the dates of the hearing of the case, as may be fixed by this Court."

Learned counsel for the Applicant states that the Applicant has complied with the Order dated 10.11.2014, inasmuch, the Applicant is regularly attending the trial Court as directed for the last two and half years. The said fact is not disputed by the learned APP.

Perused the papers. It is not in dispute that the Applicant has been reporting to the trial Court on every Monday, as directed since 10.11.2014, apart from attending the Court dates. Considering the same, the Application is allowed in terms of prayer clause (a). The condition of reporting the trial Court every Monday stands relaxed. However, the Applicant shall attend the trial Court on the dates given by the trial Court. Liberty is granted to the Applicant to renew his prayer as far as prayer clause (b) is concerned, after six months. 5.

Accordingly, the Application is disposed of.
