Heard learned counsel for the appellants. Learned counsel for the appellants submits that in view of passage of time, she wish to withdraw the appeal with liberty to move afresh before the Trial Court for modification of the order dated 18/11/2011.

After having perused the impugned order and after hearing the learned counsel for the appellant, appellant is permitted to withdraw the appeal with liberty to move afresh before the learned Judge of the Court below for modification of the order dated by pointing out pressing need to do so. Said application be decided on its own merit. Appeal is disposed of as withdrawn. Pending Civil Application is also disposed of. (V. M. DESHPANDE, J)
