Heard the learned counsel appearing on behalf of the parties in both the Appeals.
The learned Mediator has given a report indicating therein that the parties have agreed to convert the Petition into a Petition for divorce by mutual consent under section 13-B of the Hindu Marriage Act, 1955. In view of their consent, a joint Borey 1/2
spb/ 4fca64.75-15.odt purshis / application has been filed on behalf of the appellant and the respondent for converting this Appeal into the Petition for divorce by mutual consent.
The purshis /application is allowed. Accordingly, the parties are permitted to obtain divorce by mutual consent under section 13-B of the Hindu Marriage Act, 1955. Accordingly, the parties have filed the consent terms signed by the appellant and respondent and their respective advocates. The said consent terms are taken on record and are marked "X" for the purpose of identification. Decree of divorce by mutual consent in terms of the consent terms. Undertaking, if any, given in the consent terms are accepted.
The impugned order passed by the Family Court, Bandra, is set aside. All allegations made by both the parties in the original petition for divorce as well as any observations made against both the parties by the Family Court in the impugned order are expunged.
Both the Appeals are disposed of in terms of the consent terms.
