By this petition defendant challenges order dated 02.02.2015 passed by the Civil Judge, Junior Division, Pune, below Exh. 28 in Regular Civil Suit No. 32 of 2007 rejecting the defendant's application for condonation of delay in filing written statement. The learned counsel for the petitioner submits that during the pendency of the present Writ Petition, the trial court has decided Regular Civil Suit No. 32 of 2007 on its own merits. Hence, nothing survives in the present petition. He seeks liberty to withdraw the petition. To that effect, he has given in writing on Farad. Same is taken on record and marked "X" for identification.
