Learned counsel appearing for the petitioner seeks liberty to withdraw this petition and states that his client would file a civil suit for adjudication of title.

Writ petition is dismissed as withdrawn. If any civil suit is filed by the petitioner, the same shall be decided on its own merits. All other issues including the issue of limitation on merits are kept open. The suit shall be decided without being influenced by the observations made by the authority in the impugned order which is subject matter of this petition. No order as to costs. In view of disposal of the writ petition, pending civil application is disposed of.
