Heard the learned counsel appearing for the petitioner and the learned AGP for the first to seventh respondents. The learned AGP tenders on record an affidavit of Shri Dunda Pandurang Mali, Circle Officer, Rajur Tahsil, Junnar, Pune. In paragraph 4 of the affidavit, he has stated that he had no knowledge about the order dated 8th September 2017 passed in Writ Petition No.9787 of 2017 and therefore, he confirmed the Mutation Entry No.5726 on 19th November 2017. The learned AGP on telephonic instructions of Shri Dunda P. Mali states that the Circle Officer will reverse Mutation Entry No.5726. We accept the said statement.

The learned AGP on instructions states that the first respondent will decide the pending revision application within a period of three months from today. We accept the said statement.

ORDER

(i) We accept the statement made by the learned AGP on telephonic instructions of Shri Dunda Pandurang Mali, Circle Officer that the Mutation Entry No.5726 will be reversed. We, accordingly, direct the Circle Officer to take necessary steps within a period of two weeks from today; (ii) We accept the statement that the first respondent will decide the pending revision application within a period of three months from today. We, accordingly direct the first respondent to decide the revision application within a period of three months from today;

(iii) All contentions on the merits of the revision application are kept open;

(iv) The Petition is disposed of.
