The above Civil Application has been filed seeking the following relief :- "That the Respondent No.1 may be directed to deposit an amount of 46,00,000/- being the difference between 12% interest and 9% interest in this Honourable Court and that amount may be deposited in the Nationalized Bank subject to the outcome of the Petition." The above Petition has been admitted on 17/7/2002 and interim relief has been granted staying the order passed by the Registrar directing refund of the interest on the ground that higher interest has been charged. The interim stay was granted after hearing the Applicant i.e. the Respondent No.5 to the above lgc

In so far as the relief claimed vide the said Civil Application is concerned, there is no change in the circumstances so as to entitle the Applicant/original Respondent No.5 to claim the said relief. The said relief would also be contingent upon the decision that would be rendered in the above Petition. The above Civil Application is accordingly rejected. In the facts and circumstances of the present case, the above Petition, which is of the year 2001, to be added to the final hearing board. The above Petition accordingly to be shown on the final hearing board at the appropriate place in the week commencing 17th August 2015.
