The petitioner submits that as the the Respondents are failed and neglected to comply with the order dated 03/02/2021 passed by this Court in Writ Petition (St.) No. 2809/2020 holding the elections of Respondent No.6 Mumbai District Central Co-operative Bank Limited, they filed present contempt petition.

The learned counsel for Respondent Nos. 2 and 3 submits that they have filed their affidavit in reply dated 13/07/2021. He submits that as per GR dated 06/04/2021 it is not possible for them to hold elections because the State Government has postponed the elections of all the Cooperative society till 31/08/2021. 4.

When this Court declined to entertain the present contempt petition in view of GR dated 06/04/2021, learned counsel for the Petitioner submits that the Petitioner may be permitted to withdraw with liberty to file appropriate proceedings. He has given in writing to that effect. The same is taken on record and marked 'X' for identification. The same accepted.

The contempt petition is dismissed as withdrawn with liberty as prayed.
