Heard learned counsel for the parties.

Learned counsel for the Applicant No.2 presses the Application for pre-arrest bail qua the Applicant No.2. The Applicant No.2 seeks pre-arrest bail in connection with C.R.No.33 of 2017 registered with the Ozhar Police Station, Nashik, for the alleged offences punishable under Sections 353, 332, 394, 379, 143, 147, 323, 504, 506 of the Indian Penal Code. 3.

Learned counsel for the Applicant No.2 states that no role has been assigned to the Applicant No.2 in the commission of

the alleged offences.

Learned APP also does not dispute the fact that no overt act has been attributed to the Applicant No.2 in the commission of the alleged offences, except the fact that he was present at the spot with his car. There are no antecedents against the Applicant No.2.

Considering the aforesaid, the Applicant No.2 is granted pre-arrest bail on the following terms and conditions:- O R D E R (i) In the event of arrest, the Applicant No.2 - Deepak Rampratap Agrawal, be enlarged on bail on furnishing P.R.Bond in the sum of Rs.15,000/- with one or two sureties in the like amount;

(ii) The Applicant No.2 shall attend the concerned police station on every Monday and Friday from 10.00 a.m. to 11.00 a.m. till the date of filing of the charge-sheet; (iii) The Applicant No.2 shall not tamper with the evidence or attempt to influence the complainant, witnesses or any person concerned with the case;

(iv) The Applicant No.2 shall inform his latest place of

residence and mobile contact number and/or change of residence or mobile details, if any, from time to time to the Court seized of the matter and to the Investigating Officer of the concerned Police Station;

(v) The Applicant No.2 to cooperate with the conduct of the trial.

Accordingly, the Application is disposed of.
