The petitioner herein has challenged the order dated 15th February, 2017 passed by the Additional Sessions Judge for Greater Bombay, Dindoshi, Mumbai.

The records reveal that by order dated 25th May, 2016, the Sessions Judge had suspended the sentence imposed against the petitioner subject to the petitioner depositing Rs.20,00,000/- (Rupees Twenty Lakhs) within two months & on furnishing bonds of Rs.50,000/-. At the request of the petitioner, the time to deposit the amount of Rs.20,00,000/- was extended. The petitioner once again filed an application dated 15th February, 2017 seeking further time to deposit the amount. By order dated 15th February, 2017, the learned Sessions Judge extended the time by way of final opportunity. The said order was not adverse but was in consonance to the prayer made in the application dated 15th February, 2017. Challenge to this order is

Be that as it may, the learned counsel for the petitioner submits that the petitioner will deposit an amount of Rs.5,00,000/- (Rupees Five Lakhs) within two weeks from today and balance amount of Rs.15,00,000/- (Rupees Fifteen Lakhs) within two months thereafter. The statement is accepted.

In the light of the above statement, nothing survives in the petition. Writ Petition No.1422 of 2017 stands disposed of accordingly. (SMT. ANUJA PRABHUDESSAI, J.)
