DATED : 8th JUNE, 2022 P.C:- Heard learned counsel for the applicant and learned APP for the State.
The applicant was directed not to be arrested by an order dated 6/4/2021 and by further order passed by this Court on 24/8/2021, he was granted protection from his arrest, in the wake of the prima facie case recorded in his favour in the order. Needless to state that the applicant is enjoying the protection till date.
It is not the case of the prosecution that the applicant has not attended the police station as directed or co-operated with Tilak
2/2 9 ABA 945-21.doc the investigation. The learned APP fairly state that the custodial interrogation of the applicant is not warranted. In the wake of the aforesaid statement, the order dated 24/8/2021 is made absolute.
The applicant shall continue to render his cooperation to the Investigation and shall not make any attempt to tamper with the evidence or pressurise the complainant in any manner.
Application is disposed off.
