P.C.:- 1] After having argued the matter for sometime, Counsel for the Petitioner submits that Petitioner be granted liberty to move afresh, as he does not want to press Application-Exhibit-140 below which order impugned dated 23/11/2016 is passed. Since the prayer is innocuous, same is granted. Application-Exhibit-140 preferred in pending RCS No.133 of 2008 on the file of Civil Judge, Junior Division, Junnar stands disposed of as not pressed. However, Petitioner is at liberty to take out proceedings on the same line which be adjudicated on its own merits without being influenced by withdrawal of the earlier Application-Exhibit-140.

2] Petition is accordingly disposed of.
