Mr. Pol, learned counsel for the Applicant states that the Applicant is charge-sheeted in an offence of murder, the date of complaint being 06/05/2019 and he was shown to be arrested on the date of the incident. However, till date, no charge is framed is his grievance though the charge-sheet is instituted on 30/08/2019.

Though I expressed my disinclination to release the AJN

2/2 35 BA-1519.21.odt Applicant on bail, I find sufficient justification on the submission of learned counsel for the Applicant that he cannot be kept incarcerated indefinitely, without trial, and proactive steps must be taken so that the trial commences. With an expectation and hope that the charge shall be framed in Sessions Case No.177 of 2019 within a period of six months from today and, if it is not done, reserving the liberty to move a fresh Application, the present Application is disposed of as withdrawn.
