Heard learned advocate on the application for condonation of delay of 76 days in preferring appeal along with application for leave to file appeal. Apparently, delay was due to sickness of the complainant as reportedly he was suffering from jaundice. Medical papers are produced on record. Considering the grounds given in the application, delay is condoned. The application is allowed and disposed of. The application for leave along with the appeal challenging acquittal of the respondent is kept for admission on adjourned date. Stand over to 1st July, 2015. In the meantime, the applicant to serve the respondent No.1 with copy of the application for leave to file appeal and/or appeal memo and relevant documents. The learned APP for the State and Advocate for respondent No.1 waive service.
