Heard learned counsel for the applicant and learned APP for the Respondent - State.

By this application, the applicant seeks pre-arrest bail in connection with C.R.No.123 of 2017, registered with the Bharti Vidyapeeth Police Station, Pune, for the alleged offence punishable under Section 354
2/4 of the Indian Penal Code.

Learned Counsel for the applicant submits that the allegation as against the applicant is that he entered the complainant's house, held her hand and thereby outraged her modesty. He submitted that according to the complainant, she started shouting, as a result of which her husband knocked the door, pursuant to which she opened the same and the applicant fled away from the spot.

Vide order dated 3rd April, 2017, the applicant was directed to attend the concerned Police Station from Monday to Friday, between 10.00 a.m. to 12.00 noon.

Learned APP states that the applicant has been attending the concerned Police Station as directed by this Court. 6.
Perused the papers. The allegation as against the applicant is that he entered the complainant's house, held her hand and thereby outraged her modesty. It is not in dispute that as the complainant raised hue and cry
3/4 the complainant's husband knocked the door, pursuant to which, the complainant opened the door and the applicant fled away from the spot. 7.
Considering the nature of allegations as against the applicant, the application is allowed and the applicant is granted pre-arrest bail on the following terms and conditions :
ORDER
(ii) In the event of the arrest, the applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs.20,000/- with one or two sureties in the like amount ;
(ii) The applicant shall report to the Investigating Officer of the concerned Police Station on every Monday, between 10.00 a.m. to 12.00 noon, till the filing of the charge-sheet; (iii) The applicant shall not tamper with the evidence or attempt to influence the complainant, witnesses or any person concerned with the case.
4/4 (iv) The applicant shall inform his latest place of residence and mobile contact number and/or change of residence or mobile details, if any, from time to time to the trial Court and to the concerned Police Station, in writing;
(v) The Applicant shall co-operate with the Investigating Agency. 8.
The Application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the observations made herein are prima facie and are confined to this application and the learned Judge to decide the case on its own merits, uninfluenced by the observations made herein. 10.
