Heard Learned counsel appearing for the Petitioner. The impugned order is passed by the Industrial Court at Nasik on a revision under Section 44 of the M.R.T.U. & P.U.L.P. Act, 1971. The original complaint of the Respondent-employee was dismissed for default by the Labour Court. Subsequently, upon cause being shown for failure to appear on the part of the Respondent, the complaint was restored. The restoration order was the subject matter of challenge in the revision. The order of restoration, passed after recording the Respondent's evidence and after hearing both parties, does not exhibit any infirmity. There was no merit in the revision and the same was rightly rejected. There is no merit in the present petition. Hence, the petition is dismissed.
