None appears for the Petitioner. The record shows that although the petition was filed on 7/4/2015, none appeared for the Petitioner on 6/10/2015, 17/11/2015. On 29/6/2016 when the matter was circulated this Court (Coram: K.K.Tated, J) had observed that despite the fact that there was no urgency, the matter was circulated. Hence, the Petitioner was saddled with cost of Rs.5,000/-, which is paid. Thereafter, there was no steps taken by the Petitioner. The Petitioner happens to be Defendant No.1 in Special Civil Suit No.658/2013. 2.

The order dated 2/2/2015 permitting the Plaintiff to carry out the proposed amendment has been challenged before this Court. By the said order, the Plaintiff was permitted to carry out the proposed amendment within 14 days on payment of cost of Rs.500/-. The amendment must have already been carried out. 3.

In view of this, it appears that the Petitioner is not interested in
