In view of the fact that the charge sheet has been filed on 9-92017 and considering the fact that the offence under Section 506(2) of the IPC is cognizable, we do not deem this a fit case to exercise our Writ Jurisdiction. The only submission urged on behalf of the Applicant was that the offence under Section 506(2) is non cognizable which is belied by the Notification issued by the State Government. The above Criminal Application is accordingly dismissed.

However, it would be open for the Petitioner to avail of the statutory remedies if so advised. If any such application is made, needless to state that the same would be heard and decided on its own merits and in accordance with law.
