The Petitioner has sought to raise a challenge to the interim order dated 23rd February 2024 passed in Miscellaneous Application No.70 of 2024. This miscellaneous application has been filed in Original Application No.771 of 2023 where the Petitioner seeks modification of the temporary final seniority list dated 15th June 2023. 2.

By the order dated 23rd February 2024, the Tribunal while granting time to the Respondents to file reply observed that if any promotions were made, the same would be subject to the outcome of the Original Application.

Since the miscellaneous application itself is pending before the Tribunal, we are not inclined to interfere at this stage. It is informed that

Sayyed 11-WP.4258.2024.doc the Respondents have filed their affidavit-in-reply to the said miscellaneous application. Since the proceedings are now listed on 1st April 2024, all contentions can be raised before the Tribunal. 4.

Needless to state that the Tribunal is free to consider the miscellaneous application on its own merits. Keeping all points raised in the writ petition open, the Writ Petition is disposed of.
