By this Petition under Article 227 of the Constitution of India, the petitioner has challenged the order dated 30.1.2016 passed by the learned Judge, Family Court No.5, Bandra, Mumbai below Exhibit-8 in Petition No.B52/2015 for issuing witness summons to the respondent. Ms. Deshmukh submits that either she will collect the RPAD packet and submit it to the U.S. Consulate or office of the Family Court will submit it to the U.S.

In view thereof, the impugned order is set aside reserving liberty to the petitioner either to collect the RPAD packet from the Family Court and submit it to the U.S. Consulate or permit the office of the Family Court to submit RPAD packet to the U.S. Consulate, for effecting service on the respondent. The petitioner is, therefore, free to appear before the Family Court for exercising any of the above options. Petition is disposed of in aforesaid terms. Order accordingly.
