After arguing for some time learned counsel for the petitioner submits that they may be allowed to withdraw the petition with liberty to file appropriate application before the Deputy Registrar, C.S. MHADA, Bandra (E), Mumbai under Section 22 of the Maharashtra Co-operative Societies Act, 1960 for issuing share certificate in his favour in respect of flat No. 1/5 situated at Shivaji Nagar, Shree Ganesh Co-operative Housing Society, Dr. Annie Besant Road, Worli, Mumbai 400 030, in view of subsequent development that conveyance is executed in favour of respondent - society by MHADA. To that effect he has given in writing. The same is taken on record and marked "X" for identification. The same is accepted.

The writ petition is disposed off as withdrawn with liberty as granted.
