Heard learned Counsel for the parties. The petition is disposed of, by consent of parties, in terms of the following order : (I) The impugned order of the Industrial Court dated 18 February 2016 is set aside and the matter is remanded to the Labour Court for a fresh hearing in accordance with law.

(II) All rights and contentions of the parties on merits are kept open. (III) The Respondent shall be entitled to apply / press his application for interim reliefs before the Labour Court. Such application, if any, shall be heard on its own merits and in accordance with law.

(IV) If any party applies for expeditious hearing of the complaint / interim application, the request shall be considered sympathetically by the Labour Court.
