This is an application for initiating appropriate action against the respondent No.1/husband for deliberate disobedience of the order passed by this Court dated 17/12/2015. The applicant is the wife. By an order dated 17/12/2015 passed in Criminal Writ Petition No.3763 of 2015, the respondent/husband was directed, to continue to pay Rs.10,000/- per month as maintenance from the date of passing of the said order. The present application is filed in the premise that the respondent/husband did not comply with the said direction passed by this Court. This application came up for hearing before this Court on 26/04/2016, when at the request of the learned counsel appearing for Gaikwad RD 1/2
909.APPWNo.1582016 the respondent No.1/husband, the period to comply with the order dated 17/12/2015 and to deposit the arrears in the registry of this Court, was extended for one week from 26/04/2016. The present application was thereafter adjourned today for hearing. 2.
The respondent No.1/husband is personally present in the Court and he through his counsel has tendered an amount of Rs.40,000/- in cash to the applicant/petitioner in Court, in presence of the learned counsel for the petitioner. The applicant/petitioner has accepted and acknowledged the said amount.

In view of the same, nothing survives in the present application, and is accordingly disposed off. 4.
It is, however, made clear that the order dated 17/12/2015 passed by this Court is not modified and the same shall remain in force until further orders.
