Notice was issued on the said application and the Registry has recorded that respondent No. 1 was duly served, whereas the notice to respondent No.2 is returned unserved with bailiff remark "dead on 05.11.2018". Though, respondent No.1 is served, none represent him.

The applicant in paragraph Nos. 2 to 4 has set out the reasons for the delay and on its perusal, I am convinced that the delay is bonafide and has been sufficiently explained. 5.
