Both the Advocates state that the dispute in the Revision Application relating to the offence punishable under Section 138 Negotiable Instruments Act is settled between the parties. The respondent who is present in the Court, confirms the settlement. In that

Both the Advocates also state that, the amount of Rs.4,60,000/- deposited by the applicant in the trial Court is agreed to be withdrawn by the respondent. The respondent is accordingly at liberty to withdraw that amount.

In view of the decision of the Apex Court in the case of Damodar S. Prabhu Vs. Sayed Babala H. reported in (2010) 5 SCC page 663, the applicant is directed to pay costs of 15% of the cheque amount i.e. Rs. 3,45,000/- to the Maharashtra State Legal Services Authority, within a period of four weeks from the date of receipt of a copy of this order.

In view of disposal of the Revision Application, Criminal Application No. 150 of 2015 does not survive. The same is accordingly disposed off.
